Product Licence and Limitations

Licence granted

Purchase gives the customer a non-exclusive, non-transferable licence to use and customise the purchased Watchkeeper documents for the vessel or operating business covered by the selected licence.

Unless another licence is expressly purchased, the standard licence applies to one vessel.

Permitted use

The purchaser may:

edit the supplied Word documents for the licensed vessel
print reasonable copies for onboard and office use
store working copies in the purchaser’s own records system
provide relevant completed records to crew, contractors, insurers, surveyors or regulators for legitimate operational purposes
create vessel-specific completed records from the templates

Prohibited use

The purchaser must not:

resell, sublicense or redistribute the editable templates
share the complete product with another unrelated business or vessel
upload the templates to public drives, forums, social-media groups or document libraries
remove Watchkeeper branding and market the templates as another commercial product
imply that AMSA, PZJA or another regulator approved or endorsed the product
use a single-vessel licence across multiple vessels unless the licence expressly permits this

Purchaser responsibilities

The purchaser is responsible for:

confirming current legal and regulatory requirements
determining whether a simplified or full SMS is required
customising the documents to the actual vessel, crew, equipment and operation
checking certificate, survey, crewing, fisheries, diving and workplace-safety requirements
maintaining genuine operational records
using official regulator forms and reporting systems where required
reviewing the system after changes, incidents and at appropriate intervals
seeking competent professional advice where necessary

Important limitations

Watchkeeper products:

are independent commercial templates
are not AMSA-approved
are not PZJA-approved
do not guarantee compliance
do not guarantee an inspection result
do not guarantee survey acceptance
do not guarantee issue or renewal of a Certificate of Operation
do not replace legal, engineering, survey, medical, diving or fisheries advice
do not replace official regulator forms

Digital products and updates

Regulations, guidance, regulator processes and forms can change.

Customers remain responsible for checking current requirements, even where product updates are offered.

Any update entitlement is governed by the offer displayed at the time of purchase.

Intellectual property

Copyright and intellectual-property rights in the original Watchkeeper templates, product structure and branding remain with Watchkeeper or the relevant rights holder.

The customer retains ownership of their vessel-specific information and completed operational records.
